Terms & Conditions

By clicking on the ‘Place Order’ button or ‘subscribe’ button at the end of the order process, you are consenting to be bound to, agree to, and understand Avant Garden’s (www.avantgarden.co.nz) Terms and Conditions as stated below.

1. Products

1.1 All products as depicted on this website (as may be varied due to seasonality and availability) are available for local Auckland delivery.

1.2 All products are subject to availability. We reserve the right to substitute with a product of equivalent value and quality without notice.

1.3 In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full no later than 30 days after the intended delivery date.

1.4 All products are delivered/received with the flower care card. It is your responsibility to ensure these steps are followed to keep your flowers as fresh as possible.

2. Pricing

2.1 All prices quoted on our website are in New Zealand dollars (NZD).

2.2 Prices include GST.

2.3 Product prices exclude delivery charges. 

2.4 We reserve the right to change without notice, the price, or prices of any, or all products, including delivery, listed on Avant Garden’s website.

3. Orders / Payment

3.1 During the order process, you will be required to provide us with your complete personal details, together with those of the intended recipient and all necessary payment details.

3.2 If the customer opts to pay via PayPal, purchases on Avant Garden’s website will be redirected to PayPal for the electronic transaction.

3.3 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.

4. Delivery

4.1 Your intended delivery date will be confirmed in your email order confirmation. We process orders received on Sundays or Public Holidays the next working day. Delivery is not available on Sundays or public holidays.

4.2 Orders will not be dispatched until full payment is received.

4.3 To avoid problems or delays with delivery, please ensure that you have included the full address details and telephone number of the intended recipient. Also, please include your telephone number and e-mail address so that we can notify you in the event that any delivery problems are encountered.

4.4 We use a third party delivery service for our orders. Avant Garden shall not be in any way responsible for any losses, damages, costs or other consequences (direct or indirect) arising from such delay or non-delivery through a third party.

4.5 Please note that Avant Garden is only responsible for delivering to the address you provide. Where the goods have been correctly delivered, we cannot accept responsibility if the intended recipient has moved, or lives elsewhere, or if an incorrect address was provided. 

4.6 An additional delivery charge will occur if our services are required for a second, third or multiple delivery attempt/s.

4.7 Where the delivery driver is unable to find someone to accept delivery, they will leave the order in a safe and sheltered place. If the delivery driver is unable to access the property, they will return the delivery to Avant Garden where contact will be made with the recipient to arrange re-delivery or collection.

4.8 In the instance of there being difficulties in delivering your order to the intended recipient, we reserve the right to contact the recipient using the contact details you provide at the time of placing your order.

5. Cancellation and Refund Policy

5.1 Orders may be amended or cancelled up to 3 working days before the intended delivery date. To amend or cancel your order, please contact Avant Garden from 9.00am – 5pm Monday to Friday using the contact details set out on our Contact page.

5.2 Orders may not be canceled on or after the requested order delivery date.

5.3 If, in the rare occurrence, you receive damaged or unsatisfactory goods from Avant Garden, please contact us immediately via email hello@avantgarden.co.nz and provide, in detail, the problem with your order. Upon receipt and review of the complaint, we will resolve the issue with either a replacement, full or partial refund, to both parties’ satisfaction.

5.4 Complaints about unsatisfactory goods must be made to Avant Garden within 48 hours of receiving the order. As Avant Garden sells perishable items, we cannot be held responsible for goods that have been received once 48 hours have passed. 

5.5 It is the responsibility of the recipient and/or purchaser of the goods to ensure the correct care is taken place for the flowers to remain fresh as long as possible. Avant Garden is not responsible for goods that have been neglected or handled poorly once the goods have left our flower studio.

6. Mailing List

By purchasing from Avant Garden you agree to be automatically added to our (e-mail) mailing-list. You can unsubscribe at any point using the link in our newsletter or mailing list emails.

7. General

7.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to Avant Garden’s website and/or Avant Garden’s delivery service. We will post any changes on the website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access Avant Garden’s website. Changes will be made effective immediately, after the posting of any such change. All subsequent dealings between you and us shall be on the new terms and conditions.

7.2 Additionally, we reserve the right to suspend, restrict or terminate access to Avant Garden’s website at any time.

7.3 We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.

7.4 Whilst we agree to use all reasonable endeavours to ensure that Avant Garden’s website is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of Avant Garden’s website and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of Avant Garden’s website impossible or impractical.
